    Hi all,

    Please let me know what could be the problem. On Apr25, my status changed to Case Received and Pending. Last Updated Date is 05/18.

    When i contacted my employer, he says my petition is approved. But still when i find the status online, it's not reflected.

    What could be the problem?

    Any thoughts would be highly aprpeciated.

    There is no need to withdraw your 485. But why do you need 2 485's. It just shuts out visas for others. You can continue on H1b with your current employer and join in EAD with the other.

    Hello,

    Contact a good attorney asap. Your details would most probably raise anyone's eyebrows at USCIS/DOS/ICE. Also, a lot depends on exact dates when you entered/left US and when your different applications were rcvd by respective govt egencies as these details will help you to establish that you are not in violation of any US laws.     My wife went to US consulate in Kuwait for her H4 stamping on Feb 18th. During the interview she was informed that some administrative process on their end was not completed and asked to pay for the DHL service and was told that she would be contacted by DHL who would collect her passport, get the visa stamped and return it to her. She was also told that it should not take more than 2 weeks.. On her application form, the interviewer wrote NO PIM.

    Since then it has been a harrowing time for us. It has been 6 weeks, since then and we still have not heard anything. We have tried contacting the consulate using phone, email and at times my wife personally went to the consulate but she was not allowed to enter. We do not hear anything back from them.

    I can understand a couple of weeks, but now its more than 6 weeks and counting. We have already cancelled her and my son's flight tickets once. We have rescheduled my son's doctor's appointment. This delay is having a domino effect on our lives.

    My question is - Is there anything that we can do to expedite this process.

    Understood. However, my question is still is unanswered. My question was when can I apply for the new 3 year H1-B term

    Scenario1: I can apply after 1 year anniversary of leaving H1 adding the 15 days spent in the US on B2 status ?

    Scenario2: I can apply after the the 1 year anniversary of my last entry in the US which is obviously on B2 visa since I have entered a couple of times on B2 after leaving H1 ?

    Question 2
    A related question is how does the USCIS know my H1 cancellation date ? Do I ask my previous employer for it ? It cant be my last US paycheck date because my employer put money in my account a few months after I left H1 as well because of some payroll issue. The H1-B visa stamp was cancelled also few months after the actual leaving H1 date when I got my B2 stamp .

    Hi All...

    My attorney filed my EAD (mailed) on August 28 this year and last Friday I saw the approval too on USCIS site. Today I decided to help one of my friends with his EAD so I decided to pull the attorney filed copy of my I-765, I noticed that attorney had mentioned "AOS" in Q:15 instead of H1B. I am on H1B and I have never used my EAD... so I am worried now and I don't know what are my options now... Would you please take few minutes of your precious time and help me with the options I may have now to correct this issue?

    I tried to find answers in other forums but didn't find any.
    I would appreciate if any attorneys/knowledge people can help me with this

    Doing a AR11/Change of address, do I include all these as additional applications

    1. MTR number
    2. Appeal number
    3. Original 485 (denied) for primary applicant
    4. Original 485 (denied) for spouse
    5. Denied 140 number

    or just these
    1. MTR number
    2. Appeal number

    Also, i have a pending date-error request with my H1B and H4 extensions, do i include the H1B and H4 numbers as well.

    This is getting complicated and i have just 2 more days before the 10days rule for filing AR11.

    Anybody who had a pending appeal during a change of address, please reply.

    11. Currently in process to apply grant to pharma industry of nearly 100K. I have very good chance of getting this grant.

    Already applied for EB2 NIW. My university is ready to apply for me under EB1-B (outstanding researcher). What are my chances of getting approval under EB1-b with above qualifications? If possible please suggest bests ways I can present my application to USCIS. I would really appreciate your response. Thanks.

    at one point. Your school should have an office of international students or such who would have clear understanding of scenarios such as yours. In addition, an immigration attorney needs to be consulted.

    Why not use the IV attorney by asking questions?
