The old I-140 is all valid. The only thing that you are taking is the date. When your new I-140 is approved and you interfile with I-485 then you request USCIS to take the new I-140 instead of the old one. Also if your new I-140 has problem at that stage (even after approval, some time it happens), still the old I-140 is valid.

We have come to a point where lot of friends would be joining us. I would encourage all of DC/MD/VA members to open their houses to host or support financially or donate miles or do anything that would minimize the expenses for our fellow friends and make them welcome.

1st time prevailing wage was OK (lower than the salary). This time during extension, prevailing wage is more that the salary, though salary increases over the time. So employer is telling they r not able to renew H1B, because it is hard to increase the salary due to the inequity among employers. What is the solution? Thanks

Bob is right. Don't buy anything from any camera shop in Brooklyn. Those package deals are not deals at all. They are a huge scam designed to steal your hard earned $ and leave you so frustrated at their total lack of customer service that you give up. If the price of any equipment is considerably less than B&H, Amazon, Adorama, or J&R, stay away. The stuff you'll get in that package will not be what you think it is. Six years of my H1B expires on Oct 2010. Company A had filed my PERM in April 2009. I was laid off by Company A in Jan 2010. I found another employment and joined Company B in Feb 2010. Company B has filed for H1B transfer with 2 months recapturing while I was outside US thus possibly a visa date of Dec 2010. I've read in this forum that Company B can ask for 7th year extension based on pending LC for more than 365 days with Company A. But my LC from Company A was approved in Feb 2010. Company A will not file I-140 for me. Can someone please tell me if it is still possible for 7th year extension with approved PERM but no pending I-140?
I'm seeking help here as I need to plan ahead for kids education and home. Thanks to IV.

Thanks for your response. I did check the extension form many times and also reviewed it from another person. Because of their same last name and similar first name we all missed the mistake. We took an infopass appointment for tomorrow. Also we did go to CBP but they told us to file I 102 for my mother-in-law to get new I-94. Also I think I have to send the my father-in-law's I-94 to the following address for correction

Guys,
After a long time I am logging into IV board. It was difficult period. Moved from TX to VA During January start. It took long to get me a good "matching" job and had to move on EAD. Sent the "proof of employment letter" to lawyer for AC21 notification.

Doesn't the date fall on a Sunday? It is probably a system update: I belive that similar things have happened to others. Don't worry and enjoy your weekend.
My EB2- I140 (INDIA) approved on March 09, 2007. We also have received our EAD last year after filing I-485 in July 2007.
I was checking online status and for my I-140, last updated date shows January 06, 2008. (My EB2 PD is OCT 2006). Can any one explain why the I-140 showing update date of 01/06/2008. The online status says following text :
Application Type: I140, IMMIGRANT PETITION FOR ALIEN WORKER
Current Status: Case approved; approval notice e-mailed.
On March 9, 2007, this I140 IMMIGRANT PETITION FOR ALIEN WORKER was approved and we sent you an e-mail notice. Please follow any instructions on the notice. If you move before you receive the notice, call customer service.

Is it possible to change to Consular processing while I-140 and I-485 is in pending.
I filed 485 in Aug and do not have the receipt either.
Kindly advice.

The Kentucky Consular Center in Williamsburg, Kentucky has registered and notified the winners of the DV-2010 diversity lottery. The diversity lottery was conducted under the terms of section 203(c) of the Immigration and Nationality Act and makes available *50,000 permanent resident visas annually to persons from countries with low rates of immigration to the United States.
Winners should start finding out very soon. Notifications to the randomly-selected diversity visa or "green card lottery" winners are being sent between May and July 2010.
How does it all work?
Soon an official letter from the U.S. Department of State Kentucky Consular Center (KCC) in Williamsburg, Kentucky will be sent to the mailing address that you provided in your entry. Being selected as a lottery winner does not guarantee that you will receive a visa; you must still apply and qualify for the immigrant visa.
